The Muslim Council of Britain (MCB) commends South Africa for its resolute commitment to justice and human rights, as demonstrated by its invocation of the Genocide Convention against Israel, and its presentation in support of it today, before the International Court of Justice (ICJ).  

South Africa’s legal counsel presented a comprehensive and compelling case, highlighting 75+ years of historical injustice against the Palestinian people. This included the Nakba in 1948, the ongoing denial of Palestinians’ right to self-determination, 56-year occupation of Palestinian territories, and the 17-year Israeli blockade of the Gaza Strip. The case underscored how decades of impunity have empowered Israel to escalate its onslaught on the Palestinian people and their territories.  

Key arguments made during South Africa’s presentation before the ICJ illustrated how Israel’s actions demonstrated a systematic pattern of conduct from which genocide can be inferred, backed by 13 weeks of evidence. The evidence, in turn, was described as “chilling, overwhelming, and incontrovertible.” 

It was made clear by the South African legal team that without a halt to military activity, Gaza risks becoming uninhabitable, a place of death and despair.

This, in turn, necessitates the indication of provisional measures, and that the failure to issue them would mark a departure from jurisprudential precedence established within the court. 

MCB Secretary-General, Zara Mohammed, said: 

“Today, we commend South Africa, who once again has championed justice and human rights on the international stage. The noble defense they present against apartheid and charges of genocide resonates deeply with the enduring legacy of leaders like Nelson Mandela and Archbishop Desmond Tutu, who fought for freedom.

South Africa’s impassioned plea at the International Court of Justice echoes the collective voice of millions worldwide, yearning for an end to the ongoing massacre. Their unwavering stance not only highlights the dire situation in Gaza but also exposes the regrettable silence, from those who continue to facilitate this siege. 

As we reflect on the first day of ICJ proceedings, it is fitting to recognise South Africa’s application to the ICJ to halt and penalise Israel’s actions in Gaza which marks a pivotal moment in human history—a crucial call for accountability and justice.

Now is the time for the international community to pay heed to the calls of millions of people around the world, and for Israel’s war on Palestine to end.”
