TS-SFD-04 Trust & Stewardship Strategic Fundraising & Development CORE Excellence v2.9.7

Legacy & Major Gift Program

Assesses the formal program for legacy and major gifts, which operationalizes *Sadaqa Jāriyah*. This secures long-term sustainability, deepens donor trust through stewardship, and ensures enduring community benefit, fulfilling the organization's *Amānah* (trust) to its stakeholders. The program includes robust restricted-fund governance, conflict-of-interest controls, and risk-based due diligence to protect the charity’s reputation and ensure donor stipulations are honoured lawfully and Islamically.

Fiqh Principles

Al-Muslimūn ʿalā shurūṭihim

Muslims are bound by their conditions. Donor stipulations must be honoured unless they contradict Shariah.

Lā ḍarar wa lā ḍirār

No harm and no reciprocating harm. Used to guide gift refusal decisions (e.g., reputationally toxic gifts).

Sadaqa Jāriyah

Ongoing charity or gifts intended to yield enduring benefit after one's death.

Amānah

The sacred trust of honoring donor intent, ensuring prudent stewardship, and maintaining transparent reporting.

Waqf

The classical Islamic model for structuring, investing, and governing perpetual endowments or gifts.

Islamic Concepts

Iḥsān

Excellence that goes beyond mere compliance, demanding due diligence, ethical screening, and Shariah-compliant processes.

Maṣlaḥah

Public interest. The program must be managed to achieve the greatest public good and enduring community benefit.
